1. GENERAL INFORMATION

1.1. The present General Contracting Conditions (hereinafter: "General Conditions" or "Contracting Conditions"), shall expressly regulate the relations arising between Barcelona LED Iluminación, S.L., (hereinafter also Barcelona LED) with address at calle Nápoles 129-131, local 7, CP 08013 of Barcelona (Spain), with NIF B 65519571, e-mail comercial@barcelonaled.com and inscription in the Mercantile Register of Barcelona. Entry 31028996 , journal 1106 entry 2143 volume 42399, folio 78, page B-406823 registration 1, and third parties (hereinafter "Users") who register as users and / or purchase products through the online store of the website (www.barcelonaled.com, hereinafter the "Store") which guarantees that it is over eighteen years and has the capacity to enter into binding contracts. By means of these General Conditions, the user is informed that Barcelona LED Iluminación, S.L. may, at any time and without prior notice, modify the content of these General Conditions and any particular conditions that may exist.

2.  OBLIGATIONS OF THE USER

2.1. The User undertakes, in general, to use the Store, to acquire the Products and to use each of the services of the Store diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that may prevent, damage or impair the normal operation and enjoyment of the Store by Users or that could damage or cause damage to the property and rights of Barcelona LED Iluminación, S.L., its suppliers, Users or in general any third party.

2.2. The user who buys at barcelonaled.com and chooses the method of withdrawal of the order in store, when picking up the order at the selected store must provide the documentation proving his identity and a copy of the order.  

3. PRODUCTS AND PRICES

Barcelona LED Iluminación, S.L. (www.barcelonaled.com) reserves the right to decide, at any time, the Products offered to Users through the Shop. In particular, Barcelona LED Iluminación, S.L., may at any time add new Products to those offered or included in the Shop. Likewise, Barcelona LED Iluminación, S.L., reserves the right to stop providing or facilitating access and use at any time and without prior notice of any of the different types of Products offered in the Store.

3.2. The Products included in the Store shall correspond as closely as possible that allows web display technology to the Products actually offered. The characteristics of the Products and their prices appear in the Shop. The prices indicated in the Store are in Euros and include VAT, unless otherwise indicated.

Barcelona LED Iluminación, S.L. will be able to modify the prices of the products whenever it considers it opportune. For this reason, the User, when accessing the web pages where the prices of the products of Barcelona LED Iluminación, S.L. are shown, must ensure that they are the updated version and not a previous version that his terminal has saved in an internal memory. It is for this reason that when accessing the prices of products and services is committed to click on the icon "Update". 

In the case of the bulb 0,99€ (Ref. B1358), cash on delivery will not be accepted, the shipping of returns or exchanges of product will be borne by the buyer without exception. This promotion CANNOT BE ACCUMULATED with other discounts or coupons.

COUPONS:

All coupons used on web, will be valid for ONE USE ONLY per user and address unless otherwise indicated, the expiration of each coupon will be informed in each promotion and will be subject to possible changes and expiration according to availability.

ABOUT CUSTOMER GROUPS AND EXTRA DISCOUNTS:

Barcelonaled.com applies special discounts to different customer groups such as professional groups, installers and distributors, discounts vary according to the user group. Barcelona LED Iluminación S.L. reserves the right to apply or not these discounts to campaigns or promotions offered throughout the year.

In the week of November prior to Black Friday and Black Friday the promoted products will not have accumulated discounts and in case of duplicity, the highest discount among those available will be applied.

Specific promotions such as e-Day or other promotions with high discounts will not be applicable to professional groups.

It should be remembered that certain products are already discounted and no additional discount will be applied to them when carrying out promotions, as is the case of the entire category of LED Growing Panels and individual products such as references B1358-X-XX, B525XX, B526XX, where X is understood as the variants on the product. In addition, there are certain product lines for professional use that are published with NET prices and discounts already applied.

4. PROCEDURE AND METHOD OF PAYMENT OF THE PRODUCTS

Within a maximum period of twenty-four (24) hours, Barcelona LED Iluminación, S.L. will send an e-mail to the User, confirming the purchase. Said e-mail will assign a reference code of the purchase, and will detail the characteristics of the Product, its price, the shipping costs and the details of the different options to make the payment of the Products to Barcelona LED Iluminación, S.L.

4.2. The User who purchases a product through the Store must make the payment through the payment systems specifically detailed in the Store.

4.3. Barcelona LED Iluminación, S.L., will file the electronic documents in which the contract is formalized, sending a copy to the user once the purchase is made. The contract shall be made in the Spanish language.

4.4. The order confirmation sent by Barcelona LED iluminación, S.L., is not valid as an invoice, only as proof of purchase. Barcelona LED iluminación, S.L., will send together with the Product the corresponding invoice.

5. RIGHT OF WITHDRAWAL / RETURN

5.1. In accordance with the legal regulations in force, you have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period shall expire 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired the material possession of the goods.

To exercise the right of withdrawal, you must notify Barcelona LED Iluminación, S.L., at the following address: calle Nápoles 129-131, local 7, CP 08013 de Barcelona (Spain), or telephone number: 932418081, or email: comercial@barcelonaled.com your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or email). You may use the model withdrawal form below, but its use is not compulsory.

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.

The return of a product, which is not due to a cause attributable to the quality or warranty offered by Barcelona LED (errors in the selection of color, size of the bulb, error in the selection of the type of product), shall be borne by the customer, who will have to send us the material to be paid along with a copy of the invoice to the following address:

For the acceptance of the return, the product must be in perfect condition, with the original packaging, including instructions (essential to keep the box).

The return will be monetary or by exchange of products, at the buyer's choice, for the amount of the order.

The shipping costs for the return of the product shall be borne by the buyer. In the event that Barcelona LED assumes the return costs, these will be deducted from the amount to be paid.

In the event that the product is not in perfect condition, we will not make any kind of return or exchange, giving the possibility of sending the products to the customer freight collect.

The customer will bear the costs of returning the goods, paying the shipping costs to our headquarters.

IN THE CASE OF LED STRIPS, LED NEON LIGHTS AND CABLES, NO RETURNS OR EXCHANGES WILL BE ACCEPTED IF THERE ARE VISIBLE CUTS TO SIZE, USE OF ADHESIVE, SOLDERING OR ANY MANIPULATION MADE BY THE BUYER OR MADE AT THE REQUEST OF THE BUYER.

RETURNS FOR DEFECTIVE MATERIAL:

No product manipulated by the customer or derived from misuse, breakage, etc., will be exchanged or credited, being void the product warranty. In case of defective product, the shipping costs will be borne by BARCELONA LED. In all other cases, these will be borne by the customer.

In case of replacement of a product, this may not necessarily be the same as the previous one, although in any case an equivalent, compatible and improved version or model, given that LED products are subject to continuous improvement in their performance.

If the product is in good condition, but the packaging (box, plastic or wrapping) is not in good condition, the return will not be accepted.

Both the collection of the product and its corresponding return will be managed by Barcelona LED through our courier service, in the case of replacements and repairs.

Returns of material in peninsula:

The return of a product, which is not due to a cause attributable to the quality or warranty offered by Barcelona LED (errors in the selection of color, size of the bulb, error in the selection of the type of product), shall be borne by the customer, who will have to send us the material to be paid along with a copy of the invoice to the following address: Barcelona Led lighting: Passeig del Mig, 6-12, Polígono Industrial Can Balmes, 08460 Santa Maria de Palautordera (Barcelona).

Returns of material from the Canary Islands, Ceuta, Melilla:

The return of a product, which is not due to a cause attributable to the quality or warranty offered by Barcelona LED (errors in the selection of color, size of the bulb, error in the selection of the type of product), will be borne by the customer, who will have to send us the material to be paid along with a copy of the invoice to the following address: Barcelona Led Lighting: Passeig del Mig, 6-12, Polígono Industrial Can Balmes, 08460 Santa Maria de Palautordera (Barcelona) (ALL TAXES, CUSTOMS AND EXPENSES ARISING FROM RETURNS WILL BE AT THE COST OF THE CUSTOMER).

For the acceptance of the return, the product must be in perfect condition, with the original packaging, including instructions (essential to keep the box).

The return will be exclusively monetary for the amount of the order. In case the buyer wishes to exchange or replace the product, he/she will have to return the material for credit, and process a new purchase.

The shipping costs for volume charges will be 50€ up to 100€. Then for each additional 100€ of purchase will be increased by 20€.

Example: if you bought 101€ the shipping costs will be 70€. If you bought 199€ the shipping costs will be 70€. If you bought 201€ the shipping costs will be 90€ and so on.

In the event that the product is not in perfect condition, we will not make any return or exchange, giving the possibility to send the products to the customer freight collect.

5.2. Consequences of withdrawal:

In case of withdrawal on your part, we will refund all payments received by you, except delivery charges if any, as well as the additional costs resulting from the choice by you of a mode of delivery other than the least expensive mode of ordinary delivery that we offer, without any undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to carry out this reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any costs as a result of the reimbursement.

We may withhold reimbursement until we have received the goods.

You must return or deliver the goods directly to us without undue delay and in any event not later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before this period has expired.

You will have to bear the direct cost of returning the goods.

In case of return of the goods due to lack of conformity (shipping error, defective product, package damaged during shipment), the cost of return will be borne by Barcelona LED Iluminación, S.L.

You will only be responsible for the diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5.3. Model withdrawal form:

(You need only complete and send this form if you wish to withdraw from the contract).

(*) Delete as appropriate.

5.4. In case of withdrawal or return of the product for lack of conformity, you must also send us a copy of the delivery note or invoice. Also, depending on your method of payment, you must tell us where we should make the payment.

We do not accept returns of products in poor condition with signs of misuse, in the case of products that are not for use in wet or aquatic environments such as swimming pools, outdoors or sea, we will not accept their return if they have signs of moisture as we make clear the IP of resistance in each product, nor will we accept the return of the product if it has suffered damage due to poor electrical connections in the facilities.

6.  CUSTOMER SERVICE

6.1. For any incident, claim or exercise of their rights, the User may send an email to the address comercial@barcelonaled.com

7. HOME DELIVERY SERVICE

7.1. The territorial scope of sales through the Store is for the territory of the Spanish geography, so the delivery service will only be for that territory. The Products purchased through the Store will be sent to the delivery address indicated by the User once the payment has been verified, being the maximum delivery time of thirty (30) days established by default in the Law.

7.2. The delivery service of Barcelona LED Iluminación, S.L., is carried out in collaboration with different logistic operators of recognized prestige. Orders will not be delivered to PO Boxes, hotels or other non-permanent addresses.

7.3. The cost of shipping is not always included in the price of the products. Free shipping for all orders with a minimum purchase amount of 30 €, has exceptions for certain communities such as the Canary Islands, Balearic Islands, Ceuta, Melilla and Andorra that have their own shipping policy, which can be consulted by clicking here. At the time of purchase of the Product, the User will be informed of the exact shipping cost.

In case of non-execution by Barcelona LED Iluminación, S.L., because the contracted good or service is not available, the User will be informed of the lack of availability and will recover, as soon as possible and, in any case, within a period of thirty (30) days at the most, the amounts paid.  

7.4. For orders placed with advance purchases, payment must be made by credit card, paypal or bank transfer, the delivery time is 30 days for this type of orders, except in cases of force majeure or natural disasters.

8. PROCEDURE FOR TERMINATION OF THE CONTRACT BY THE CONSUMER.

8.1. The User, at any time prior to the conclusion of the contract, may cancel his order and once the contract has been concluded, must comply with the provisions of the section on Withdrawal / Return of these General Conditions (clause 5).

9.  WARRANTIES.

9.1. Conformity of the products with the contract. In the absence of proof to the contrary, it shall be understood that the products are in conformity with these General Conditions provided that they meet all the requirements expressed in the regulations in force, except that due to the circumstances of the case, some of them are not applicable.

9.2. There will be no liability for lack of conformity that the User knew or could not have been unaware of at the time of conclusion of the contract. This shall not include possible deficiencies caused by normal use or wear and tear of the products or those caused by blows or improper use.

9.3. Guarantee periods. Barcelona LED is liable for any lack of conformity that appears within a period of two (2) years from delivery, always in accordance with the different conditions stipulated by the law in force. Unless there is proof to the contrary, the delivery is understood to have been made on the day appearing on the invoice or corresponding delivery note, if this is later. The User has to inform Barcelona LED, of the lack of conformity within two (2) months from the date of knowledge of the same.

Special conditions: the warranty period is based on a maximum operation of 4,000 hours/year at an ambient temperature of 25 ºC and with 10cm of space around the body of the LED Products. By default, the purchaser receives a 2-year warranty.

This warranty only covers products applied in the uses for which they were conceived or "normal use" defined as follows:

- the operating conditions are in accordance with the information reflected on the Products and their packaging.

- the ambient temperature must never exceed the operating temperature range of -20 ºC to +30 ºC (for LED Tube: -30 ºC to +45 ºC).

- the relative humidity in the installation must never exceed 80% RH and must never exceed the IP rating of the Product if applicable.

- the products must operate in an open luminaire (and in a closed luminaire for LED Tube), with a minimum of 10cm of space around the body of the Products.

- the electrical installation in which the Product operates must not be subject to voltage fluctuations within a range exceeding 230 V +/- 10%.

BLACK FRIDAY: The products discounted for this promotion have a legal guarantee of 30 days, if it is by final auction.

10. DATA PROTECTION.

10.1. We inform you and you authorize us, that the personal data that you provide us and those that may be generated from your relationship with us, are incorporated into a file or files, responsibility of BARCELONA LED ILUMINACIÓN, S.L. (BARCELONA LED), with address at calle Nápoles, nº 129-131, local 7, Cp 08013 de Barcelona, for the purposes of: managing your registration, and if necessary the management of your purchase; general, accounting, fiscal and administrative administration, maintenance, compliance, development, control and management of your relationship with us; in the event that you have indicated affirmatively to the registration of our newsletter, that you can be sent during and after our relationship commercial communications of our own and third parties in our sector by any means including by electronic means including email, sms or similar.

Also if you choose that the delivery of the material is made in any of the stores of Barcelona Led, to make the delivery in the store you select, you authorize that your data can be provided to the store concerned, even if it is not own store and is an external point of sale.

Your data may be communicated in the event that it is necessary for the payment process, for example with the entity you select to manage the payment either by card, bank transfer or Paypal. Your data may also be processed and/or communicated for the fulfillment of existing contractual and/or legal obligations.

10.2. If the User provides us with personal data of third parties or gives them to us in the future will have to have previously informed and have asked such third party consent to the ends here exposed. The User also undertakes to keep the data provided to us updated and to inform of any changes that may exist in the data, otherwise it will be considered that they have not been modified and are accurate and up to date.  

10.3. You may exercise your rights of access, rectification, cancellation and opposition by writing to BARCELONA LED at the address specified above, indicating on the envelope: BARCELONA LED Privacy Policy. Likewise, you must be over eighteen years of age to be able to register, provide your data and, if applicable, contract with us.

10.4. For all of the above, it shall be understood that, in the event that you provide us with your data, you expressly authorize us to process it, as described above.

11. INTELLECTUAL AND INDUSTRIAL PROPERTY.

11.1. The User acknowledges that all elements of the Store and each of the Products, the information and materials contained therein, trademarks, structure, selection, arrangement and presentation of its contents, and computer programs used in connection with them, are protected by intellectual and industrial property rights of Barcelona LED Iluminación, S.L. itself, or third parties, and that the General Conditions do not attribute with respect to such intellectual and industrial property rights any rights other than those specifically provided for therein.

Unless previously authorized in writing by Barcelona LED Iluminación, S.L., or where appropriate by the third party holders of the corresponding rights, or unless it is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lease, loan, make available, or allow access to the public through any form of public communication of any of the elements referred to in the preceding paragraph. The User shall use the materials, elements and information accessed through the use of the Store only for their own needs, agreeing not to make any direct or indirect commercial exploitation of the materials, elements and information obtained through the same.

11.3. The User shall refrain from circumventing or manipulating any technical devices established by Barcelona LED Iluminación, S.L., or by third parties in the Store.

12. LINKS.

12.1. The links contained in this Web site and that redirect the user to other Web sites managed by third parties, in which www.barcelonaled.com does not exercise any control; www.barcelonaled.com is not responsible for the contents or status of such sites and does not recommend or endorse their contents.

13. LIMITATION OF RESPONSIBILITY

Barcelona LED Iluminación, S.L., reserves the right to interrupt access to the Portal, as well as the provision of any or all of the Services provided through the same at any time and without prior notice, whether for technical, security, control, maintenance, power failure or any other cause.

Barcelona LED Iluminación, S.L. shall not be liable in the event of interruptions of the Services, delays, errors, malfunctions and, in general, other inconveniences that have their origin in causes beyond the control of Barcelona LED Iluminación, S.L., and/or due to wilful or negligent action of the user and/or due to Force Majeure.

14. VALIDITY OF THE CONTRACT.

14.1. If any of the clauses of the present General Conditions should be considered null and void or inapplicable, this shall not affect the remaining clauses, which shall remain in full force and effect.

15. APPLICABLE LAW AND JURISDICTION.

15.1. These general conditions are governed by Spanish law. Any dispute arising from the interpretation or execution that may arise in relation to the validity, interpretation, performance or termination of this contract shall be subject to the Jurisdiction and Jurisdiction of the Courts and Tribunals of the City of the User, provided that it is a consumer.

For cases in which the regulations foresee the possibility for the parties to submit to a jurisdiction, both parties, expressly waiving any other that may correspond to them, submit to the Courts and Tribunals of the city of Barcelona (Spain).
